Terms and Conditions of Hire

 

PAYMENT
(a) The hirer shall pay Hamiltons Events 7 (seven) days prior to commencement of the hire period or at such other time as shall be agreed in writing by Hamiltons Events.
(b) A 25% deposit on order will be required due to the nature of the equipment or services being supplied by Hamiltons Events. This type of payment is non-refundable and will then require full payment between 14 to 7 days Prior the hire date.
(c) Payment of any sums not due at commencement of the hire period shall be made by the hirer to Hamiltons Events within 7 (seven) days from the issue of Hamiltons Events invoice.

 

NO TITLE TO THE HIRER
The equipment is hired by Hamiltons Events to the hirer for the hire period at the hire rate set out in the agreed hire contract and the hirer shall be a mere bailee of the equipment and no interest or title in the equipment shall pass to the hirer. This agreement is personal to the hirer and is not capable of assignment nor sub-hire nor may the hirer part with possession of the equipment.

 

TERMINATION OF THE HIRE PERIOD
The hire period shall determine and Hamiltons Events shall be entitled to immediate recovery of the equipment in the following events:
(a) Expiry of the hire period specified in the hire quotation
(b) Immediately upon the breach by the hirer of these terms and conditions of hire
(c) By agreement to be confirmed in writing
(d) In the event of loss or damage of the equipment upon such date as Hamiltons Events agrees to accept from the hirer the equipment in its then such state and condition and compensation in accordance with these terms and conditions of hire.

 

NOTICE OF ACCIDENTS
If the equipment is involved in any accident resulting in injury to persons or damage to property the hirers will give Hamiltons Events immediate notice by telephone to be confirmed in writing by the hirer.

 

INSURANCE
Unless otherwise agreed in writing by Hamiltons Events the hirer shall prior to taking possession of the equipment enter into a contract of insurance with respect to the same for the full replacement value of the equipment under an all risks policy subject only to normal market restrictions and excesses with the name of Hamiltons Events endorsed thereon as the owner and joint insured in respect of the hire period. The hirer shall do everything necessary to maintain the said policy in full effect and not to do anything whereby the policy will or may be vitiated. Insurance & public/product liability can be taken out through Hamiltons Events @ 5% of the Marquee, furniture (staging, dance floor, lighting, tables & flooring) & linen equipment hire charge.

 

CROCKERY & CUTLERY
Damage and Loss
All damage, breakage and loss including to containers to be paid for and deductible from deposit at Hamiltons Events replacement/repair/cleaning charges. Alternative goods not accepted.
Return Dirty Services
Availability of these services to be verified and paid for at time of and part of order. 30% will be added to the crockery/cutlery hire charge to be returned dirty, items returned dirty without prior booking/payment will be subject to 50% surcharge.

 

LINEN
Laundering is INCLUDED in the hire charge. Do NOT fold linen when wet - it can be ruined by mildew within hours. Full replacement charge may be made for linen returned damp, torn, pinned or stapled, or with candle grease, cigarette burns, sticky tape, mildew or stains which normal laundering will not remove. Please note that Party Poppers will stain linen, especially if wetted or left on or inside linen, and such stains cannot normally be removed.

 

FORCE MAJEURE
The performance of Hamiltons Events obligations hereunder is subject to variation or cancellation consequent upon Act of God, war, strikes, riots, lock outs or other labour disturbances, fire, flood, restrictions on the use of transport fuel or power or any other cause beyond the control of Hamiltons Events. In the event of frustration of the agreement due to any of the above causes the contract shall be deemed complete and upon written notice by Hamiltons Events to the hirer to that effect Hamiltons Events shall refund to the hirer any monies received in respect of the hire contract less 10% which shall be retained by Hamiltons Events in respect of its costs and expenses.

ACCESS

Any problems in accessing the site due to no fault of Hamiltons, or that beyond hamiltons control, which incurr costs will be chargable to the hirer.

 

Hamiltons Events terms & conditions need to be signed, dated & returned no later that 7 days prior to installation of equipment.
